By accessing or using RANQD, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the service.
1. The Service
RANQD provides cloud-based software for racket sports coaches and coaching academies (“the Service”). It includes a public coaching profile, session and lesson scheduling, bookings and waiting lists, memberships and credit packs, trainee records and development plans, and a record of the credentials a coach holds.
2. Accounts and Access
Access to the Service is through a coaching business account:
- You must be at least 18 years old to open a coaching business account - it is a commercial agreement
- Trainee accounts are created by the coaching business. Where a trainee is under 18, their account is operated by their guardian until they turn 18, or until the guardian chooses to hand it over sooner.
- Each member of your staff must have their own sign-in - you may not share admin credentials
- You are responsible for maintaining the security of your account credentials, and for all activity that occurs under your account
- You must provide accurate information when registering
3. Subscription Plans and Billing
RANQD is a paid service. Subscriptions are billed monthly or annually in advance through Stripe. Your billing currency is set from the country you give at signup and is fixed for the life of your subscription. Paddle Sports Ltd is not VAT-registered, so no VAT is charged.
- Prices are set separately in each currency rather than converted, so the price you are shown is the price you are charged
- Where a plan has no price in your currency, it is offered in pounds sterling
- This applies only to what you pay RANQD. What your trainees pay you is section 4, and is charged in pounds sterling
- Subscriptions auto-renew until cancelled
- You may cancel at any time; access continues until the end of the paid period
- No refunds are issued for partial periods, except where required by law
- We reserve the right to change pricing with 30 days’ notice
4. Payments Between You and Your Trainees
This is separate from section 3, and the distinction matters. Section 3 is what you pay RANQD. This section is what your trainees pay you.
- Where you charge for sessions, memberships or credit packs, the money is taken through your own Stripe connected account and settles to you. You are the merchant of record. The contract for the coaching is between you and your trainee; RANQD is not a party to it.
- RANQD takes no commission on your takings. The platform fee on session and credit-pack charges is zero.
- You set your own cancellation and refund policy in the Service - including refund windows, no-show fees and what happens to a rained-off session - and the Service applies it automatically. Whether that policy is lawful, and fair to your customers, is your responsibility.
- Chargebacks, disputes, and any refund beyond your stated policy are matters between you, your trainee and Stripe.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Upload or transmit malicious code, spam, or harmful content
- Impersonate another person or misrepresent your affiliation, your qualifications, or the checks you hold
- Record health information about a trainee beyond what you need in order to coach them safely, or without the consent of that person or their guardian
- Resell, sublicense, or commercially exploit the Service without our written consent
6. Safeguarding and Coaching Children
If you coach children, meeting your safeguarding obligations is yours alone. That includes a criminal-record check (DBS in England and Wales, PVG scheme membership in Scotland, AccessNI in Northern Ireland, Garda vetting in Ireland), safeguarding and first aid training, insurance, and the rules of any governing body you coach under. One of those obligations is enforced by the Service itself, and you should know exactly how it behaves before it happens to you:
- If your criminal-record check or your safeguarding training is out of date - or has never been recorded - the Service stops accepting new junior bookings for you immediately. Any one of DBS, PVG, AccessNI or Garda vetting counts as the check. That covers junior-only sessions and any booking made for someone under 18 on any session. In an academy this applies per coach: it is the credentials of whoever is on court that decide, so one coach lapsing does not close a colleague’s sessions.
- Bookings already made are not cancelled straight away. You have 30 days from when we first see the lapse to record the renewal. Upload it and everything reopens at once, with nothing else to do.
- After 30 days, any junior bookings still outstanding are cancelled and refunded in full - your own cancellation policy is not applied, because the cancellation is ours and not your customer’s. We email you when the lapse is first seen and again a week before the deadline.
- We do not tell your trainees or their guardians why a session was cancelled. They receive the ordinary cancellation notice.
- The Service records what you tell us and when it expires, and warns you at 90, 30 and 7 days. Those reminders are an aid, not a substitute for your own compliance, and RANQD does not verify that any check you record is genuine, current, or yours.
- Obtaining and recording a guardian’s permission before photographing or filming a child is your responsibility. The Service gives you somewhere to record it and will refuse to attach video to a junior who has no video permission on file.
- Do not enrol children under 13 who are in the United States. US law (COPPA) requires parental consent verified by prescribed methods, which the Service does not implement.
7. Your Content and Data
You retain ownership of all data you input into RANQD (trainee records, session history, development plans and coaching notes). By using the Service, you grant us a limited licence to store, process, and display that data solely to provide the Service to you.
You are responsible for ensuring you have the right to input personal data about other individuals - your trainees, their guardians and your staff - and that doing so complies with applicable data protection law. RANQD acts as a data processor in respect of trainee data; you are the data controller under the UK GDPR and Data Protection Act 2018.
8. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice, or emergency maintenance without notice where necessary. We are not liable for losses arising from downtime.
9. Intellectual Property
RANQD, its logo, design, software, and associated materials are the intellectual property of RANQD. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.
10. Limitation of Liability
To the maximum extent permitted by law, RANQD’s total liability to you for any claim arising from use of the Service shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
11. Termination
We may suspend or terminate your account if you breach these Terms, with or without notice depending on severity. You may terminate your account at any time by contacting us. On termination, your data will be retained for 90 days then deleted, unless legal retention obligations apply.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
13. Changes to These Terms
We may update these Terms with 30 days’ notice for material changes. Continued use of the Service after the effective date constitutes acceptance. If you do not accept the changes, you may cancel your subscription before they take effect.
